How we use and disclose health information

Treatment

We may use and disclose information to evaluate your health, provide care, coordinate treatment, and communicate with healthcare professionals involved in your care. Examples include sending a prescription to a pharmacy, ordering laboratory testing, reviewing results, or coordinating a referral. Additional consent requirements apply when required by law.

Payment

We may use and disclose information to obtain payment for services, manage billing, and resolve payment questions. Depending on the services and payment arrangements, this may involve billing administrators, payment service providers, or an insurer. We limit disclosures as required by law.

Healthcare operations

We may use and disclose information for permitted activities such as quality improvement, practice administration, compliance, audits, staff training, and care coordination. We may contact you about appointments, follow-up care, and treatment alternatives or health-related services, as permitted by law.

Service providers and affiliated administrative services

We may use service providers for electronic records, telehealth technology, billing, and other permitted functions. When HIPAA requires a business-associate agreement, we require one before permitting that organization to handle protected health information on our behalf.

Pure Wellness & Rejuvenation LLC assists with certain billing and pharmacy coordination functions. Information is disclosed for these functions only as permitted by applicable law and subject to required safeguards. Pharmacies and other treating providers may have their own privacy notices. This notice covers Pure Wellness & Vitality LLC and does not automatically serve as a joint notice for a separate entity.

People involved in your care

With your agreement, or when the law otherwise permits, we may share information relevant to care or payment with a family member, friend, or other person involved in your care. You may object. If you cannot communicate your wishes, we may make a limited disclosure based on professional judgment and your best interests. We may also disclose limited information for disaster relief when permitted.

Other disclosures permitted or required by law

Subject to applicable legal conditions, we may use or disclose information:

  • To comply with a legal requirement, including an authorized privacy compliance review.

  • For public health reporting, medication safety reporting, recalls, or other authorized public health activities.

  • To report suspected abuse, neglect, or domestic violence when permitted or required.

  • To help prevent a serious and imminent threat to health or safety.

  • For authorized health oversight activities, including licensing reviews and investigations.

  • For research when the required authorization, waiver, or other legal conditions are satisfied.

  • To coroners, medical examiners, funeral directors, or organ procurement organizations for legally authorized purposes.

  • For workers’ compensation, specified government functions, or legally permitted law enforcement purposes.

  • In legal proceedings when a valid order, subpoena, or other request satisfies applicable privacy requirements. A request alone does not override those requirements.

Information requiring additional protection

Some records are subject to additional federal or state restrictions, including certain substance use disorder, mental health, HIV-related, genetic, and other sensitive information. We apply those restrictions when they govern the records or disclosure. A general permission described above does not override a stricter requirement.

If we receive or maintain substance use disorder records protected by 42 CFR Part 2, those records, and testimony revealing their contents, cannot be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you unless you provide the specific written consent required by Part 2 or the disclosure is supported by an appropriate court order and subpoena or similar legal mandate. Other applicable Part 2 conditions must also be met. Not every reference to substance use in a medical record is a Part 2 record.

Uses requiring your written authorization

We obtain written authorization for uses and disclosures not otherwise permitted by law or described in this notice. Authorization is generally required for marketing that requires authorization under HIPAA, a sale of protected health information, and most uses or disclosures of separately maintained psychotherapy notes, subject to limited legal exceptions.

You may revoke an authorization in writing through our Privacy Officer. Revocation does not undo actions already taken in reliance on it.

If we conduct legally permitted fundraising, you may opt out of future fundraising contacts. If fundraising would use Part 2 records, we will first provide a clear notice and an opportunity to choose whether to receive those communications. Your choice will not affect treatment or payment eligibility.

Your rights

Access to records

You may request inspection or a copy of information in your designated record set, including medical and billing records, subject to limited legal exclusions. Contact our Privacy Officer or use the available portal request process. We generally act within 30 days, or sooner where applicable law requires. If a lawful extension is necessary, we provide written notice explaining the reason and expected completion date. Any fee must be permitted by law. If access is denied, we explain the basis and any available review rights.

Correction of records

You may request an amendment to information you believe is inaccurate or incomplete. We generally respond within 60 days, subject to a lawful extension and any shorter applicable deadline. We may deny a request on legally permitted grounds. If we deny it, we provide a written explanation and information about submitting a statement of disagreement.

Confidential communications

You may request contact through a particular method or at a different location. We accommodate reasonable requests. Tell us how you prefer to receive communications.

Restrictions

You may request limits on certain uses or disclosures for treatment, payment, or operations, or disclosures to people involved in your care. We generally are not required to agree, except where the law requires. If you pay for an item or service completely out of pocket and ask us not to disclose the related information to your health plan for payment or healthcare operations, we honor that request unless disclosure is required by law.

Accounting of disclosures

You may request an accounting of disclosures that must be included under applicable law, generally covering up to six years before your request. Certain disclosures are excluded, including many for treatment, payment, operations, or those made with your authorization. The first accounting within a 12-month period is free; a permitted fee may apply to additional requests after advance notice.

A copy of this notice

You may request a paper copy without charge even if you agreed to receive it electronically.

Personal representatives

A person with legally recognized authority may exercise rights on your behalf. We verify that authority and apply any legal exceptions before sharing information or accepting instructions.

Complaints

You may complain to our Privacy Officer or directly to the U.S. Department of Health and Human Services, Office for Civil Rights. Visit https://www.hhs.gov/hipaa/filing-a-complaint/index.html or write to 200 Independence Avenue, S.W., Washington, D.C. 20201. For assistance, call 1-877-696-6775.

We will not retaliate against you for filing a complaint.

Our duties and changes to this notice

We maintain legally required privacy and security safeguards and provide notice of a breach of unsecured protected health information when required by law. We follow the privacy practices stated in this notice and obtain authorization where required.

We may revise this notice as permitted by law and apply revised terms to information already maintained and information received later. The updated notice will show its effective date and will be available on our website and upon request.
